I. BASIC PROVISIONS

Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

The Controller has not appointed a Data Protection Officer.
II. SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA

The Controller processes personal data that you have provided to the Controller or personal data that the Controller has obtained based on the fulfillment of your order.

The Controller processes your identification and contact data and data necessary for the performance of the contract.
III. LEGAL BASIS AND PURPOSE OF PERSONAL DATA PROCESSING

The legal basis for the processing of personal data is:

the transfer of personal data to the relevant Croatian authorities and the fulfillment of the Controller’s legal obligation to register guests in the Croatian eVisitor system. For these purposes, the following personal data may be required:

identity document number

nationality

date and place of birth

gender

length of stay and visa number (if applicable)

other personal data if relevant

the performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR

the legitimate interest of the Controller in providing direct marketing (especially sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR

your consent to the processing of personal data for direct marketing purposes (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in cases where no order for goods or services has been made.

The purpose of personal data processing is:

processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller. Personal data required for successfully processing your order (such as name, address, and contact information) are necessary for concluding and fulfilling the contract. Without providing personal data, the contract cannot be concluded or performed by the Controller.

sending commercial communications and carrying out other marketing activities.

The Controller may carry out automated individual decision-making within the meaning of Article 22 GDPR. You have provided explicit consent to such processing.
IV. DATA RETENTION PERIOD

The Controller retains personal data:

for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship)

until consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 5 years if the personal data are processed based on consent.

After the retention period has expired, the Controller will delete the personal data.
V. RECIPIENTS OF PERSONAL DATA (CONTROLLER’S SUBCONTRACTORS)

Recipients of personal data are persons:

involved in the delivery of goods or services and the execution of payments under the contract

involved in ensuring the operation of services

providing marketing services.

The Controller may transfer personal data to third countries (countries outside the EU) or to international organizations. Recipients of personal data in third countries may include providers of mailing or cloud services.
VI. YOUR RIGHTS

Under the conditions set out in the GDPR, you have the right to:

access your personal data pursuant to Article 15 GDPR

rectify personal data pursuant to Article 16 GDPR or restrict processing pursuant to Article 18 GDPR

erasure of personal data pursuant to Article 17 GDPR

object to processing pursuant to Article 21 GDPR

data portability pursuant to Article 20 GDPR

withdraw consent to the processing of personal data in writing or electronically to the address or email of the Controller stated above.

You also have the right to lodge a complaint with the supervisory authority if you believe that your right to personal data protection has been violated.
VII. PERSONAL DATA SECURITY CONDITIONS

The Controller declares that it has taken appropriate technical and organizational measures to secure personal data.

The Controller has implemented technical measures to secure data storage and storage of personal data in paper form, in particular the use of antivirus programs, secure storage of backups, and secure access passwords.

The Controller declares that only authorized persons have access to personal data.
VIII. FINAL PROVISIONS

By submitting an order via the online order form, you confirm that you have read the personal data protection terms and that you accept them in their entirety.

By checking the consent box in the online form, you confirm that you have read and agree with these personal data protection terms.

The Controller is entitled to amend these terms. The new version of the personal data protection terms will be published on the Controller’s website or sent to you via the email address you provided.
These terms become effective on 01 January 2023.
